An LMIA exemption refers to a situation where a Canadian employer is not required to obtain an LMIA in order to hire a temporary foreign worker. ESDC (Employment and Social Development Canada) together with Immigration, Refugees and Citizenship Canada (IRCC) maintain an index of LMIA exemptions that are arranged through the International Mobility Program.

Free trade agreements

A significant number of LMIA waivers are available through international agreements between Canada and other countries. Certain types of employees may relocate to Canada from other countries and vice versa, if they can show that this will have a positive impact. Canada has negotiated the following free trade agreements in Latin America, each of which covers a range of LMIA exemptions and includes professionals, technicians and technologists from the agricultural sector:
